Terms

These terms govern your use of the jack.ats website and any purchase, commission, or correspondence made through it. Browsing the site, placing an order, or writing to us means you accept them.

jack.ats ("JACK All Terrain Studio," "we," "us") is a multidisciplinary studio in Austin, Texas, working across goods, objects, and built space. Questions go to jack.allterrainstudio@gmail.com.

You need to be able to form a binding contract to buy from this site. If you are under 18, use it only with a parent or guardian involved.

We make things in small runs. Quantities are limited and items can sell out or be discontinued without notice. We show colors, materials, and dimensions as accurately as we can, but screens vary and handmade goods carry natural variation — differences in finish, grain, weave, or tone are part of the work, not defects.

We may correct errors, limit quantities per customer, or refuse or cancel any order at any time, including after it is placed. If we cancel an order you have paid for, we refund it in full.

Prices are in U.S. dollars and may change at any time before an order is placed. Tax and shipping are calculated at checkout. An order is an offer to buy; a confirmation email acknowledges receipt but is not acceptance until we charge your payment method and dispatch the item.

Checkout and payment are handled by Shopify. We never see or store full card details. You are responsible for accurate billing, shipping, and contact information.

If an item is listed at the wrong price or with a wrong description, we may cancel the order even after your card is charged. A refund of what you paid is the only remedy in that case, and we are not obliged to supply at the wrong price.

Orders ship from Austin, Texas, typically within a few business days unless a product page says otherwise. Delivery estimates are estimates. Once a package leaves our hands, carrier timing is outside our control, and risk of loss passes to you on delivery to the carrier.

Made-to-order pieces show a lead time on the product page. That is an estimate from the day the order is confirmed, never a guaranteed date; materials, finishing, and freight all move. If a build will run materially past its estimate we will tell you, and you may wait or cancel. If you cancel, we refund what you have paid less any material already cut or finished to your specification. If we cancel the build ourselves, you are refunded in full. Lead-time slippage is not a breach of these terms and does not entitle you to anything further.

Once a carrier has the parcel, loss, delay, and damage in transit are between you and the carrier; we will give you the paperwork to bring a claim but are not liable for the outcome. Orders shipped to a freight forwarder are at your risk entirely from the moment the forwarder signs.

International orders may incur duties, taxes, or customs fees on arrival, which are yours to pay. We cannot mark shipments as gifts or under-declare value. Refused or abandoned international parcels are not refunded.

Unworn, unwashed goods in original condition with tags may be returned within 14 days of delivery for a refund of the item price. Original shipping is non-refundable; return shipping is yours. Sale and final-sale items, and anything made to order or commissioned, are not returnable unless they arrive damaged or defective.

Made-to-order and commissioned work cannot be cancelled once fabrication has begun. Sale, final-sale, and discounted items are sold as-is and are not returnable.

Every return needs written authorization first. Write to jack.allterrainstudio@gmail.com within 14 days with photos and your order number; returns sent without authorization are refused and not refunded. Refunds go to the original payment method only, and we may reduce one to reflect any loss in value from handling beyond what is needed to examine the item. We may decline service to anyone whose return history is out of step with ordinary use.

Furniture and made-to-order pieces are warranted against defects in workmanship for one year from delivery, to the original purchaser only, with proof of purchase. The warranty is not transferable and does not survive resale. If a joint, finish, or fixing fails in normal indoor domestic use in that time, we will repair, replace, or refund it at our sole discretion. Freight both ways is yours.

It does not cover normal wear, the movement and color change wood undergoes as it ages, or damage from misuse, accident, alteration, repair by anyone else, commercial or contract use, humidity, or outdoor use of a piece built for indoors. Goods other than furniture are covered against manufacturing defects for 30 days from delivery. Anything that arrives damaged or wrong is a returns question, not a warranty one — see above.

This is the only warranty we give. To the fullest extent the law allows, all implied warranties — including merchantability and fitness for a particular purpose — are disclaimed, and repair, replacement, or refund at our discretion is your sole remedy.

Spatial, object, and made-to-order commissions are governed by a separate written agreement covering scope, schedule, deposits, and ownership. Nothing on this site is an offer to perform that work, and these terms do not replace a signed commission agreement.

The site and its contents — the jack.ats and "All Terrain Studio" names and marks, logos, photography, project documentation, copy, and design — belong to us or our collaborators and are protected by law. You may view and share content for personal, non-commercial purposes. You may not copy, resell, scrape, or use it commercially, or remove any marks, without written permission.

If you believe something on this site infringes your copyright, write to jack.allterrainstudio@gmail.com with: identification of the work, the URL of the material in question, your contact details, a statement that you believe in good faith the use is unauthorized, a statement that your notice is accurate, and your signature. We remove infringing material once a valid notice is confirmed.

Do not use the site to break the law, infringe anyone's rights, interfere with its operation or security, or collect data from it by automated means without permission. We may suspend access without notice.

We collect what we need to fill an order and answer you: name, contact details, shipping address, and order history. Payment details go to Shopify and are never held by us. Newsletter signups are used only for studio mail and can be cancelled at any time.

We do not sell your information. The full detail — processors, cookies, retention, your choices — is on the privacy page. Write to jack.allterrainstudio@gmail.com to ask what we hold about you or to have it deleted.

Anything you send us — ideas, feedback, photographs — you grant us permission to use without obligation or compensation, unless we have agreed otherwise in writing.

The site and everything on it are provided "as is" and "as available," without warranties of any kind, to the fullest extent the law allows. We do not promise the site will be uninterrupted, error-free, or secure.

To the extent permitted by law, jack.ats — and its owners, staff, and collaborators — are not liable for indirect, incidental, special, punitive, or consequential damages, or for lost profits, lost data, or loss of use, even if we were told they were possible. Our total liability for any claim of any kind is limited to what you actually paid us for the item the claim concerns.

Any claim must be brought within one year of the event it arises from, or it is permanently barred, except where the law does not allow that limit. This does not cut short the warranty in section 06 — a warranty claim can be raised at any point inside that period.

You agree to cover us against claims, losses, and reasonable legal costs arising from your misuse of the site, your breach of these terms, or your infringement of someone else's rights.

Talk to us first. Almost everything is settled by writing to us, and we would rather fix a problem than argue about it.

If that fails, you and jack.ats agree to resolve any dispute by binding individual arbitration rather than in court, and each of us waives the right to a jury trial and to take part in a class or representative action. Small-claims court remains open to either of us for claims that qualify.

You can opt out of this section. Write to jack.allterrainstudio@gmail.com saying so within 30 days of your first order, or of the first time you use this site if you never order, and it will not apply to you; nothing else in these terms changes.

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Where a dispute is not subject to arbitration, it will be handled in the state or federal courts of Travis County, Texas, and you consent to their jurisdiction.

These terms, plus any separate written agreement covering commissioned work, are the whole agreement between us. If a provision is found unenforceable, the rest stands. Not enforcing something once does not waive it later.

We are not liable for failures caused by events outside our reasonable control — supply and freight failures, labour disputes, fire, flood, severe weather, or acts of government. We may assign these terms as part of a sale or reorganization of the studio; you may not assign yours without our written consent.

We may update these terms as the studio and shop evolve. The current version always lives on this page, dated above. Continuing to use the site after a change means you accept it.
